    Interesting federal litigation exists regarding an employment discrimination suit against BMW Manufacturing Co. The suit alleges that BMW's policy of not hiring individuals with certain criminal backgrounds created a disparate impact against workers based on race for which there was no sufficient business justification. The suit specifically targets BMW's Spartanburg facility in South Carolina. In an interesting twist to the lawsuit, BMW has asked a court to order the EEOC to disclose its own treatment of applicants with criminal backgrounds. This move demonstrates the contentious nature of the litigation. The EEOC has opposed the motion on grounds that the information sought is not relevant to the case. This case is a fascinating one to follow on an important issue of disparate impact law.

    Santa Fe County clerk ordered to give gay marriage licenses

    SANTA FE (AP) -- A New Mexico district judge is ordering the Santa Fe County clerk to start issuing marriage licenses to same-sex couples. Rep. Brian Egolf, a lawyer handling a lawsuit by two Santa Fe men, said Friday that Judge Sarah Singleton's order represents the first time a New Mexico judge has ruled that gay and lesbian couples can be married. The order issued late Thursday mandates that Santa Fe County Clerk Geraldine Salazar issue the marriage licenses or appear in court to tell the judge why that shouldn't happen. Salazar did not immediately return a telephone call from The Associated Press. Around 90 same-sex couples have received marriage licenses in southern New Mexico this week since the Dona Ana County clerk decided on his own to grant them. (Copyright 2013 The Associated Press.
